Counterparties must be aware of the request for damages

Counterparties must be aware of the request for damages

Where an action for damages is impermissible, because it does not duly notified to the counterpart, the new code of the administrative process allows still require the opinion of the court on the merits of the dispute

Then, the applicant may propose, again, independent claim in the case of unlawful

In memory concluding the applicant main (which on appeal was "confidential" di chiedere il risarcimento dei danni), ha formalmente chiesto la condanna del Comune al “risarcimento del danno ingiusto, da liquidarsi anche in via equitativa”.

A tal riguardo, va osservato che, in base all’art.

Né può, in this case, forward the notification of the application, since the mere "reserve" to bring the claim for compensation (maybe in another separate opinion), does not amount to a formal proposition of the same.

Therefore, the demand for compensation made by the principal applicant in these proceedings must be regarded as unacceptable because it does not duly notified to the counterparties.

remains, however, affect the right of the applicant to assert again that request by separate action (see TRGA Bolzano, July 7, 2001, n. 171).

The Board believes that it can apply to the case in art. 34, paragraph 3, of the new code of administrative process (immediately applicable, as a procedural rule), under which, "when, during the proceedings, the annulment of the contested measure is no longer useful for the plaintiff, the court establishes the illegality of the act if there is an interest for compensatory damages. "

The principal applicant has not in fact the annulment of the award plus interest, which can not influence the effect of the contract and, consequently, the regeneration of the race, but interest in having the illegality of the acts, for compensation.

Conclusively, is determined the illegality of the contested measures with the main action under paragraph 2, 3 and 4, for compensation purposes.
The Board noted, finally, is there any ground for declaring the ineffectiveness of the contract (pursuant to Art. 122 cod. Proc. Admin.) Considered that the works have been fully executed by the company awarded .
