The characterization of the conduct of the PA in terms of tort requires, therefore, the identification of remedies to protect private consistent with the principles set out the general rules laid down in Articles. 2043 et seq. cc
Turning to the merits of the illegal, ongoing occupation of the property, it is clear that there was, in this case, all elements of civil liability cases cited by the applicant in its request for compensation , since the gross misconduct of the Administration, responsible for the availability of stolen goods and the non-restaurant owner, hence the occurrence of all the details provided by art. 2043 cc (omission, negligence of The proceeding, harm and causation) in the presence of which we can say non-contractual liability for unlawful acts of strong, consistent, precisely, in the aforementioned removal of the availability of illegal goods.
And then the Administration will have to compensate the damage by bringing the situation of permanent employment illegitimate (sic: subtraction), first in a specific form providing for the return to the rightful owners of the land used for construction public work properly restored to pristine (and, of course, corresponding compensation for the period of illegal employment).
The definition of claims thus implies an intermediate step consisting of the allocation of a defining term administration because the fate of the ownership of assets illicitly learned, which may follow, but inevitably subject position, an order for compensation according to the criteria provided for by general and comprehensive. 2043 cc
